Rule 128A
Provisions related to resignation
: (1) If a civil servant wants to voluntarily resign from his position, he must submit his resignation in writing to the office he works in.
(2) In accordance with sub-rule (1), the resignation submitted to his office should be signed by the concerned employee. However, if a civil servant who is outside Nepal needs to get his/her resignation signed, he/she can send it to the Nepali embassy and if he/she is in a country where there is no Nepali embassy, ​​he/she can send it to the notary public of the relevant country.
(3) Resignation submitted according to sub-rules (1) and (2) may be accepted by the following bodies or officers:--
(a) In the case of civil servants of gazetted first class and above, the Government of Nepal, the Council of Ministers,
(b) In the case of gazetted second and third grade civil servants, the secretary of the ministry conducting the service or the equivalent head of the department,
(c) Head of department or head of office of civil servants of gazetted and unranked posts.
(4) If a civil servant resigns from his position according to sub-rule (1), his resignation may be accepted if it is confirmed that he has no remaining liability to pay to the Government of Nepal, his employment period up to the effective date of his resignation is up to date and no departmental action has been initiated.
